ED16 - DRV Status Determination § 7a SGB IV: Application, Decision, Risk
Problem
DRV status determination (§ 7a SGB IV) is critical for a managing director of a company (GmbH, UG, etc.), but is largely unknown in the SME sector:
- "Status determination? Never heard of it." - many managing directors of a GmbH/UG do not know that the DRV can determine whether they are "employed subject to social insurance" or "self-employed"
- Risk: loss of the Aktivrente - if classified as "self-employed", the Aktivrente (§ 3 Nr. 21 EStG) no longer applies - the tax exemption for the managing director's salary (EUR 2,000) is lost
- Application submitted, response pending - the application was submitted, but the DRV is not responding - the uncertainty remains
- No deadline monitoring - no one is reminded of the status determination application or the DRV response
- No documentation in the repo - the application is in paper form, not in the repo with a sidecar
Trigger B - 1st employee (managing director): Status determination becomes relevant as soon as a managing director is employed - that is, starting with the first "employee" (often the managing director themselves). For the
SME, this is the case from 01.09.2026.
Core Message
DRV status determination in the Git repo means:
- Application as a supporting document with sidecar - SHA-256 +
V7GUID:uuidV7, stored insources/drv/ - Status: "requested, response pending" - documented in the repo, with an entry in the deadline check
- Risk documented - if classified as "self-employed", the Aktivrente no longer applies - the risk is recorded in the repo
- Decision upon receipt - DRV decision with sidecar, status updated
- Deadline check for DRV request - automatic reminder of the pending response
Compliance by Design: The status determination is not managed after the fact, but is systematically captured through supporting documents with sidecars, deadline check and risk documentation.
What Is Status Determination?
| Status | Meaning | Aktivrente | Social Insurance Obligation |
|---|---|---|---|
| employed subject to social insurance | The managing director is an employee of the GmbH/UG | retained (§ 3 Nr. 21 EStG) | yes (RV/KV/PV/AlV) |
| self-employed | The managing director is self-employed | does not apply | no |
Risk if "self-employed": If the DRV classifies the managing director as "self-employed", the Aktivrente (§ 3 Nr. 21 EStG) no longer applies. The managing director's salary (EUR 2,000) is then taxable - withholding tax rises from 0.00 to approximately EUR 200/month. The social insurance obligation no longer applies, but the tax burden increases. This is the critical risk of status determination.
Current Status: Application Submitted, Response Pending
| Step | Status | Date | Storage Location |
|---|---|---|---|
| Application submitted | completed | 260806 | sources/drv/ with sidecar |
| DRV response | pending | open | sources/drv/ (upon receipt) |
| Deadline check | active | monthly | checks/FRISTEN_CHECK.md |
| Risk documented | active | since 260806 | sources/drv/risk.md |
Practical example: The managing director (
E1) submitted an application for status determination to the DRV on 260806. The application is stored in the repo (sources/drv/) as a supporting document with a sidecar. The status is "requested, response pending". The deadline check contains an entry "DRV status determination: awaiting response - monthly". The automated alert provides a monthly reminder of the pending response.

Note: The
uuidV7is the entry's DocID. The composite keyV7GUID:uuidV7is used to organize storage and for database queries. Thestatusfeststellungobject documents the application, the status and the risk. Theworking_assumptionis "abhaengig" - until the DRV decides otherwise, the managing director is treated as employed subject to social insurance (with a social insurance obligation and the Aktivrente).
What Happens When the Decision Is Received?
| Decision | Aktivrente | Social Insurance Obligation | LSt | Action in the Repo |
|---|---|---|---|---|
| employed subject to social insurance | retained (§ 3 Nr. 21 EStG) | yes (RV/KV/PV/AlV) | 0.00 | Update status, leave payroll unchanged |
| self-employed | does not apply | no | taxable | Update status, adjust payroll, remove the Aktivrente flag |
Important - decision as a supporting document with sidecar: Upon receipt, the DRV decision is stored in the repo as a supporting document with a sidecar (SHA-256 +
V7GUID:uuidV7). The status in thestatusfeststellungobject is updated. In the case of "self-employed", payroll (ED23) must be adjusted - the Aktivrente no longer applies and withholding tax increases.
Risk Leverage
| Today (cheap) | Tomorrow (revision-proof) | Risk Mitigated |
|---|---|---|
| Application as a supporting document with sidecar | Status determination can be evidenced | Challenge to the application |
| Status: "requested" documented | Risk is transparent | Hidden uncertainty |
| Deadline check for DRV request | Reminder of the pending response | Forgotten status determination |
| Risk documented (loss of the Aktivrente) | Risk deliberately recorded | Surprise when the decision arrives |
| Decision upon receipt with sidecar | Status authoritatively evidenced | Challenge to the status |
